A consortium of Second Amendment organizations filed a federal lawsuit this week against New Jersey’s prohibition on firearm suppressors. These attachments are crucial to protecting gun users’ hearing but are commonly misrepresented by anti-gunners.
Groups include the National Rifle Association (NRA), Second Amendment Foundation (SAF), and the America Suppressor Association (ASA).
Plaintiffs note that suppressors are a courtesy to prevent noise pollution
The plaintiffs argued that “suppressors are commonly used to protect the hearing of hunters and those around them. Despite the potential hearing risks, up to 95% of adult hunters report not wearing hearing protection while hunting.”
The lawsuit declared that suppressors were invented to protect hearing by reducing the decibel levels of gunshots. They are also “commonly used as a public courtesy to prevent noise pollution from lawful target shooting in neighborhoods and communities.”

The suit further uses the Bureau of Alcohol, Tobacco, Firearms and Explosives’ (ATF) own words in making its case. The groups cited former acting ATF Deputy Director Ronald B. Turk, who noted in 2017 that suppressors “are very rarely used in criminal shootings.”
And while so-called “silencers” once had a shaky reputation, public opinion on the attachments changed in recent years.
Turk noted in an ATF White Paper that “the change in public acceptance of silencers arguably indicates that the reason for their inclusion in the NFA (National Firearms Act of 1934) is archaic and historical reluctance to removing them from the NFA.”
SAF Executive Director Adam Kraut noted that suppressors are essentially “mufflers designed to mitigate the damage caused to a user’s ears when firing a gun, no different than the muffler found on automobiles.”
Kraut added that communities benefit from reduced noise pollution and that this is a common phenomenon in other societies, such as those in Europe.
