Of all the pro-Second Amendment states in the Union, many were shocked when a major Texas entity brought the hammer down on lawful concealed carry holders. The Texas State Fair last year sparked outrage when officials denied attendees the right to possess their firearms.

A hasty court battle ensued, and ultimately, the popular event was allowed to proceed with the ban in place.

The exploding controversy followed a shooting at the Fair in 2023, and officials unilaterally decided that no one except current or retired law enforcement officers could bring firearms onto the property.

That may not be the case in 2025.

Lawmakers intent on righting this wrong are pushing SB 1065, which would prohibit lessees of public property from enacting weapons bans. The Texas Senate State Affairs Committee approved the proposal last week, allowing it to advance.

Those who lease public property would be expressly barred from stopping lawful concealed carry holders from exercising their rights on that property. The proposed law is well written and attaches a powerful enforcement provision to uphold citizens’ rights.

It reads, “A contractor that violates Subsection (b) is liable for a civil penalty of not less than $1,000 and not more than $1,500 for the first violation; and not less than $10,000 and not more than $10,500 for the second or a subsequent violation.”

And each day that such violations continue “constitutes a separate violation.”

Ouch. Fines may add up quickly if Second Amendment rights are not respected.

The clock is ticking on enacting this protection for Texas gun owners, as the State Fair opens its gates on September 26. If the measure garners two-thirds support in both chambers and is signed into law by Gov. Greg Abbott (R), it takes effect immediately.

Passage without such margins and the governor’s signature means it would be in force on September 1, still in time for the popular event.
