The U.S. Supreme Court’s recent action in Worth v. Jacobson upholding the rights of young adults to obtain a carry permit now brings even more good news for gun rights advocates.
With the arbitrary restriction on 18 to 20-year-olds struck down, the Minnesota Department of Public Safety expanded concealed carry reciprocity to 33 states.
This is a significant victory for travelers who exercise their Second Amendment right to defend themselves while away from home. Previously, Minnesota authorities did not recognize out-of-state permits from those without age restrictions reflecting their own.
The long process toward justice for young adults began two years ago, when a federal district court ruled that Minnesota’s prohibition on carry rights for young adults was unconstitutional. The court reached this determination considering the Supreme Court’s 2022 Bruen decision, which demanded that gun control laws be rooted in the nation’s Founding Era.
Shortly afterwards, the Eighth Circuit Court of Appeals unanimously determined that the ban on issuing carry permits violated the Second Amendment.
The court wrote, “Minnesota has not met its burden to proffer sufficient evidence to rebut the presumption that 18 to 20-year-olds seeking to carry handguns in public for self-defense are protected by the right to keep and bear arms.”
The state appealed to the Supreme Court, but the justices declined to hear Minnesota’s argument last month.
This swung the door wide open for the state to exercise reciprocity with residents of others states that already recognized the rights of young adults to bear arms.
Of course, young adults have long had the right to fight for their country in the military, marry, vote, enter binding legal contracts, and a host of other typical adult functions.
