Prosecutors in states that respect the Second Amendment are increasingly resorting to herding rogue municipalities back into the fold through legal action. Take Georgia as an example.
Despite being part of a state that upholds the right to keep and bear arms, Savannah officials decided on a different path. Officials in the port city last year enacted an ordinance mandating that firearms be “securely stored” when left in the owners’ vehicles.
Penalties include up to 30 days in jail and a $1,000 fine.
Georgia AG declared Savannah ordinance a “misguided attempt to punish law-abiding citizens”
First, the Georgia General Assembly took steps to counteract Savannah’s gross violation of the state’s preemption law. This is on top of numerous lawsuits filed against the historic city’s imposition of its own gun control regime.
Then Attorney General Chris Carr (R) correctly observed that the Savannah statute fails to meet the rigors of the court.
“This misguided attempt to punish law-abiding Georgians does absolutely nothing to address crime, and it won’t hold up in Court,” Carr declared in a press release announcing the filing of an amicus brief.
Savannah mayor equates public safety with gun control
The state supports plaintiffs challenging the law in Chatham County Superior Court.
Carr added, “No matter how much the mayor disagrees with our laws, he cannot openly infringe on the Second Amendment rights of our citizens.”
Savannah Mayor Van Johnson (D) attempted to lash out at the AG. “Rather than using his constitutional authority to assist in protecting our communities, he has chosen instead to take adversarial positions against the very citizens he is sworn to defend. In Savannah, we believe it is not only possible, but necessary, to protect the Second Amendment and second graders and teenagers.”
The future of the Savannah ordinance is uncertain, but courts have not been kind to municipalities attempting to circumvent state preemption laws.
