19 AGs Urge SCOTUS to Consider Young Americans’ 2A Rights

Full constitutional rights for young adults should not be in question, but when it comes to the Second Amendment, some leaders act as though the right to keep and bear arms is optional.

The issue of banning adults under 21 from purchasing a pistol may be coming to a head. An impressive lineup of 19 state attorneys general petitioned the U.S. Supreme Court in recent days to finally address this injustice.

Lower courts have delivered conflicting rulings on the issue

One of the leading proponents of complete constitutional protection for young adults is West Virginia AG J.B. McCuskey. He declared that the right to own a firearm cannot be considered separately from the right to purchase one.

“Different courts have reached different conclusions on this issue, so it’s time for the Supreme Court to answer these questions once and for all. If you adults ages 18 to 20 can vote, serve in the military, be tried as adults in criminal court, or get married, they should be able to purchase a handgun.”

McCuskey and his colleagues want the high court to settle the issue that affects some 13 million young Americans. The case is McCoy v. ATF.

AGs ask for high court clarity on the issue of young adults purchasing handguns

In June, a three-judge panel with the Fourth Circuit Court of Appeals ruled against the plaintiffs in a split decision. Somehow, two judges determined that laws present in the Founding Era established enough of a precedent to justify the prohibition. 

Just after 2025 began, the Fifth Circuit struck down the federal ban on young adults buying handguns. However, the Eleventh Circuit agreed with a similar law in Florida just four months later.

This is an issue that needs clarification from the Supreme Court. The current edition of the bench is generally favorable toward the Second Amendment but has been markedly reluctant to take on gun control-related cases.
