The U.S. Supreme Court’s monumental 2022 Bruen decision restoring some sanity to gun rights continues to reverberate across the legal landscape.
Last week, the Third Circuit Court of Appeals issued a decidedly split decision in Siegel v. Platkin. The divided bench struck down some of New Jersey’s reactionary gun control while retaining other key elements.
In other words, no one can celebrate an outright victory.
Third Circuit finds that parts of New Jersey’s gun control regime are likely unconstitutional
The good news for Second Amendment advocates is that the Third Circuit issued a preliminary injunction against parts of the law.
The New Jersey requirement that permit seekers take out liability insurance is likely unconstitutional, according to the court. Likewise for allocating part of the permitting fee to the Victims of Crime Compensation Office.
The Third Circuit further determined that requiring express permission from private property owners and the new storage mandate likely violates the Constitution.
Unfortunately, the court sided with the state on the issue of so-called “sensitive places”
However, the court in its 139-page opinion upheld the New Jersey law that established so-called “sensitive places” such as public gatherings and school settings.
This development was disappointing to Attorney for the Plaintiffs Pete Patterson. He said afterwards that, while gun rights supporters are pleased with the partial victory, they will soon determine if and how to pursue the case further.
The court further determined that the requirement for the applicant to provide four reputable character witnesses would likely pass constitutional muster.
New Jersey was one of a handful of rogue states to respond to the high court’s Bruen ruling by throwing a legal temper tantrum. Anti-gun lawmakers raced to throw together a legislative rebuttal that would even further restrict Second Amendment rights.
Dismantling these roadblocks against gun rights is a tedious process involving years of litigation. The fight against New Jersey’s gun control regime is far from over.
