The cumulative effect of years of waging battles with anti-gun politicians means that there are some restrictions still on the books that need to be abolished. A step in that direction came last week, courtesy of the U.S. District Court for the Northern District of Texas.
At issue was the federal ban on carrying firearms in post offices.
Chief District Judge Reed O’Connor sided with the plaintiffs and their challenge to the prohibition. He granted summary judgment as well as both declaratory and injunctive relief.
The Founding Fathers could have issued such a ban—and they didn’t
In other words, a resounding victory.
O’Connor skillfully defended his reasoning in upholding the Second Amendment. “It is hard to envision that the Founders would countenance banning firearms in the post office—particularly because they did not do so themselves. Thus, the Government has not carried its burden” to defend against the challenge.
Directly affected by this significant ruling are members of the Firearms Policy Coalition (FPC) and the Second Amendment Foundation (SAF).
If the public space is not secured, citizens have the right to armed self-defense
The contentious ban included post office buildings as well as parking lots.
FPC President Brandon Combs celebrated the win for his organization as a monumental victory for law-abiding gun owners across the nation.
“As we’ve said all along, governments cannot ban weapons in unsecured public spaces, full stop,” Combs declared. “For too long, peaceable people have been threatened with prosecution simply for carrying weapons for self-defense while mailing a package or buying stamps. That ends here.”
Combs added that no provision in the Second Amendment permits lawmakers to “invent new so-called ‘gun-free zones’ wherever they please.” Supporting organizations such as the FPC enables critical lawsuits to continue in support of gun rights.
