A recent U.S. District Court ruling that riled many gun rights advocates was vacated after decisive action from Second Amendment groups and the Department of Justice (DOJ).
In deciding Reese v. ATF, the Fifth Circuit ruled that young adults under 21 can purchase handguns legally. The relief, however, was restricted to residents of Texas, Mississippi, and Louisiana as well as members of the Second Amendment Foundation (SAF).
Moreover, the plaintiffs were ordered to turn over their membership list as of November 6, 2020. And they were to comply within 21 days.
2A group declares it would never cooperate with a court order to release member information to the government
That misguided order was short-lived, as the SAF, along with its partner groups and the DOJ, filed a joint motion last week to amend the court’s judgment.
Bill Sack, SAF’s Director of Legal Operations, blasted the initial command.
“We had no intention of releasing any private membership data and were prepared to take all necessary steps to ensure our member list was not disclosed,” Sack declared. “Luckily, the court responded to our joint motion promptly and vacated its original order.”
Reversal of controversial court order protected private member data
SAF founder and Executive Vice President Alan M. Gottlieb ridiculed the idea that his organization would hand over its rolls to the court.
“It’s preposterous to think we would release any type of member data to anyone,” Gottlieb said in a statement. “We’re thankful the court saw its error in the judgment and vacated the original order. However, we want to make it extremely clear—we would never release the private data of SAF supporters to the government. That’s akin to letting the fox in the henhouse, and it will never happen.”
