Delaware’s Controversial Permit-To-Purchase Scheme Set to Take Effect

The Second Amendment is under siege in Delaware, and gun rights enthusiasts know a loud clock is ticking. On Nov. 16, just days from now, state law will require individuals to obtain a permit to purchase or transfer a handgun. 

This insidious action is a leap that 2A supporters warned about for years. If implemented, government officials will have a record of every private firearm transaction in the state.

Delaware may soon have a de facto gun registry in place

Critics of gun rights need to ask themselves a question. What other specific freedom enumerated in the Constitution requires an individual to beg for a permit from the police to exercise that right?

According to the new law, “An unlicensed person may not sell or transfer any firearm to any other unlicensed person without having conducted a background check through a licensed firearms dealer.”

Only then will it be determined if “the sale or transfer of the firearm may proceed by the State Bureau of Identification, through the Firearm Transaction Approval Program.”

Potential firearm purchasers will be required to complete a safety training course

Delaware is set to join nearly a dozen other states that require a permit-to-purchase, either for all guns or just pistols. Plaintiffs filed a 49-page federal lawsuit against the law last year, and it is still in the system. 

Observers note that the suit is in U.S. District Court in Wilmington, and there is no end to the litigation in sight.

In other words, prepare for the Delaware law to take effect.

Legislators gave state police 18 months to set up the new permitting system, but, at last report, it is far from being implemented. If it takes effect, nearly everyone in Delaware except those with concealed carry permits will have to get a permit to purchase a handgun.

Before that, they must complete a safety training course covering a wide array of subjects. There are exemptions from the requirement to take the course to receive a permit, such as for active and retired law enforcement officers and members of the military.
