Despite the notorious safety issues plaguing Chicago residents, Illinois lawmakers continue to ban law-abiding citizens from carrying firearms on public transit.
The Second Amendment Foundation (SAF) and its partners are diligently at work to end this injustice with last week’s petition to the U.S. Supreme Court. The state mandates that people obtain a Firearm Owners Identification Card (FOID) to exercise their full constitutional rights on buses, trains, and other forms of public transit.
There is no historical precedent for Illinois disarming passengers on public transit
SAF Executive Director Adam Kraut blasted the prohibition as having no basis in the nation’s Founding Era. This, of course, is required by the U.S. Supreme Court’s landmark 2022 Bruen decision.
“There simply is no historical support for the idea that all modes of public transit are ‘sensitive places’ where carry can be banned,” Kraut declared. “Lower courts have struggled with understanding what a ‘sensitive place’ actually is and how limited their scope must be under the Second Amendment. This case is a great opportunity for the Court to clarify the proper unifying principle and correct the circuit courts that have gone astray.”

The road to this legal point is littered with twists and turns.
First, the District Court sided with the plaintiffs and granted summary judgment in Schoenthal v. Raoul.
That victory was short-lived, as the Seventh Circuit overturned the lower court’s ruling, reasserting that the ban was indeed constitutional. Now, the SAF and its partners want SCOTUS to provide clarity on what is an increasingly important issue.
And it’s important to remember that law-abiding citizens are not the issue on public transit. By disarming this segment of the public, violent criminals are given virtual free rein to terrorize the innocent.
