NYC Senior Citizen Sentenced to Four Years Over ‘Draconian’ Gun Laws

New York City tops current headlines over political results that some considered controversial, but for gun rights, upheaval in the Big Apple is hardly a recent phenomenon.

For decades, law-abiding citizens of the nation’s largest city have been subjected to gun laws that do everything but protect the people who need protection. Now, a senior citizen who valiantly defended himself from an attacker will be stripped of his freedom.

Queens man who defended himself from attacker headed to prison

Charles Foehner, 67, was sentenced on Thursday to four years in prison, two years after fatally shooting a man who attempted to rob him. 

The Queens resident pleaded guilty to one count of criminal weapons possession to finally draw his case to a close. 

The retired doorman was attacked by what he thought was a knife, but turned out to be a pen. The would-be robber, Cody Gonzalez, apparently charged the older man outside of his home, and what should have been an open-and-shut case of justified self-defense became anything but.

Instead, prosecutors threw the kitchen sink at Foehner after investigators found he had a cache of unlicensed firearms. New York City law historically made it quite challenging to possess weapons legally, leading some to work around the controversial statutes. 

Foehner faced 25 years in prison, so he accepted the plea deal to avoid trial. 

Attorney Thomas Kenniff told reporters outside the Queens Supreme Court this week that the city’s “draconian” gun laws caused his “hero” client to be in an “impossible position.”

“If this was a state and a city that had its affairs in order, Mr. Foehner would be getting a plaque, not a prison sentence,” Kenniff declared to the assembled media. The attorney accused city and state leaders of thwarting the Second Amendment rights of millions of good people.

“If we respected people’s constitutional right, and provided practical means for citizens to exercise that right, Mr. Foehner would not be in the position he is in today,” Kenniff explained.

The retiree told investigators after the 2023 defensive shooting that he carried the handgun due to the city’s high crime rate. He was not charged with his attacker’s death.
