Gun Parts Supplier Faces Prison for Shocking Reason

U.S. gun owners know there is still a hangover from the egregious gun control excesses of the previous administration. While much progress has been made, significant challenges to Second Amendment rights remain.

One such case involves Tim Durkin, a Gun Owners of America (GOA) member and an entrepreneur. He assisted local firearm retailers to stay afloat during the COVID lockdowns and supply chain issues, and for this, he is being persecuted

ATF is prosecuting a businessman for seemingly completely harmless actions 

The most bizarre twist to this case is that the federal government is prosecuting Durkin for “engaging in the business” of selling guns. 

This, even though he never even sold a weapon. His online business, Durkin Tactical, supplies firearms parts to customers—not guns themselves.

Because of this, the defendant does not need an FFL. But that did not stop anti-gunners in the prior White House from targeting Durkin simply because he assisted mom-and-pop gun store owners to replenish their inventories during the COVID mess.

Simply introducing two legal businesses is hardly a crime

In effect, he acted as a go-between for Anderson Manufacturing and Kansas gun shops that were struggling mightily to stay afloat. He made business introductions between suppliers and customers for a small brokering fee on a constitutionally protected item.

The Bureau of Alcohol, Tobacco, Firearms, and Explosives (ATF) sent Durkin a cease-and-desist letter in 2022, and by that point he was no longer setting up these deals, so there was nothing to fix. And for the next two years, there was silence.

But as the previous administration wound down, the embattled ATF decided he had not atoned for the sin of brokering legal deals. Someone with the agency decided that he should pay the price for introducing two completely legitimate businesses.

The excuse provided was that the brokering violated the Gun Control Act, even though that law doesn’t mention “broker.”

With the very public pronouncements that the current administration seeks to restore Second Amendment protections, it’s high time that this prosecution is shelved for good.
