Two significant developments in the fight to save the Second Amendment emerged this week, and both concerned Hawaii’s egregious concealed carry ban.
Montana Attorney General Austin Knudsen (R) led a coalition of 26 other state AGs in filing an amicus brief with the U.S. Supreme Court. The top prosecutors urged the high court to strike down Hawaii’s clearly unconstitutional restriction.
Multiple states responded to the Bruen ruling with questionable actions
Breitbart News reported that the filing heavily cited 2022’s landmark Bruen decision, a ruling that reestablished gun rights and set the standard for how gun control laws are judged.
The AGs told SCOTUS that Bruen “reminded lower courts that the right to keep and bear arms ‘is not a second-class right, subject to an entirely different body of rules than the other Bill of Rights guarantees.’”
Several states threw legislative tantrums at being ordered to respect the Second Amendment, and Hawaii lawmakers attempted to all but eradicate concealed carry.

Hawaii in effect created a gun control regime with “a default rule against public carry on private property held open to the public. Rather than presuming that public carry was permissible unless expressly forbidden, public carry is now presumptively forbidden in Hawaii unless expressly permitted,” the filing declared.
As it currently stands in Hawaii, licensed gun owners are prohibited from carrying their weapons at a nearly unlimited roster of public locations.
The filing came on the heels of the Department of Justice (DOJ) also submitting a brief to the justices to overturn the law.
Attorney General Pam Bondi (R) declared that “Hawaii’s law plainly violates the Second Amendment” and that other U.S. states are also on shaky legal ground. California, New York, New Jersey, and Maryland have similar blanket restrictions on concealed carry away from the home.
