Established federal law protects the weapons industry from frivolous lawfare intent on bankrupting the very companies that make Second Amendment freedoms possible.
The Protection of Lawful Commerce in Arms Act (PLCAA) was enacted over two decades ago to thwart increasing attacks by anti-gunners.
But now, states such as Maryland seek ways around this law to chip away at 2A protections. The firearm industry trade association, the National Shooting Sports Foundation (NSSF), launched another volley this week in the ongoing battle to protect weapons manufacturers and retailers.

The U.S. District Court of Maryland recently dismissed the NSSF lawsuit challenging the state’s effort to run an end-around on the PLCAA.
Undaunted, the advocacy group urged the Fourth Circuit Court of Appeals to reinstate the case defending gun rights. NSSF Senior Vice President and General Counsel Lawrence G. Keane noted the underhanded attack on PLCAA protections by Maryland.
The PLCAA is the firearms industry’s front line of defense against frivolous attacks
“The PLCAA prohibits the type of laws that allow frivolous lawsuits brought by Maryland Attorney General Anthony Brown seeking to hold industry members liable for criminal acts of third parties,” Keane declared. “The law gives Attorney General Brown license to target perfectly legal commerce. As a result, it not only seeks to impose a gun control agenda through litigation that not only runs afoul of the PLCAA, but it also violates the First Amendment by limiting protected commercial free speech, the Commerce Clause, due process, and the Second Amendment.”
The PLCAA, just this year, was critical in blocking a treacherous effort by Mexico’s government to impose its gun control regime on law-abiding Americans. The U.S. Supreme Court saw through these frivolous allegations and cited the law in dismissing the plaintiff’s $10 billion lawsuit.
