Senate Anti-Gunners Seek to Close Background Check ‘Loophole’

Protection of the Second Amendment would not be on the front burner as much as it is if not for the constant threat from those who would neuter it. 

Take federal background checks. There were so many jurisdictions that purposefully slow-walked firearm carry permit applications that the 1993 Brady Act had to address this issue.

Authorities have three business days to conduct a background check for potential buyers 21 and over, and ten business days for those under 21. If the process is not completed, whether on purpose or through incompetence, the sale may proceed.

This alarmed gun rights opponents, and last week, a bloc of Senate Democrats introduced the Background Check Completion Act. The built-in safeguard to ensure a streamlined process for acquiring a firearm permit would be eliminated.

In other words, officials would have free rein to stop weapons transfers until the time when background checks are finally completed.

Senators claim criminals are illegally acquiring weapons through the ‘loophole’

Supporters include Sen. Adam Schiff (D-CA) and Sen. Richard Blumenthal (D-CT). They, along with 24 colleagues, introduced the proposal, which is also known as the “No Check, No Sale” bill.

Blumenthal claimed that this “Charleston loophole” is “a massive gateway to dangerous evasion of the background check rules. If you haven’t passed a background check, you shouldn’t be able to purchase a weapon. No check, no gun. It’s really that simple.”

Only, it’s not.

The actual “loophole” the senators seek is one through which anti-gunners could arbitrarily deny the right to purchase a firearm and then concoct a reason later.

The “Charleston loophole” refers to the gunman in the deadly Emanuel AME Church attack who was able to acquire a weapon when his background check was not completed in time. The overwhelming majority of these checks are timely, but law-abiding citizens should not be penalized for bureaucratic incompetence.
