The revamped Department of Justice’s Civil Rights Division filed an amicus brief on Monday supporting the plaintiff’s challenge to California’s onerous ammunition regulations.
After all, Second Amendment rights mean little if a law-abiding citizen is unable to acquire ammunition.
New and improved DOJ backs case against unconstitutional ammunition controls
Harmeet Dhillon is the Assistant Attorney General for Civil Rights and is increasingly outspoken on such issues. She posted on X that every Californian deserves the complete protection of the Constitution and the ability to exercise their liberties freely.
“CA’s in-person background check regime—required before every ammunition purchase—restricts the ability of Californians to keep and bear arms.” Dhillon added that her agency’s amicus brief argues that “purchasing ammunition plainly falls under the Second Amendment!”
The Second Amendment Foundation (SAF) also filed an amicus brief in Rhode v. Bonta last week. The advocacy group warned that the Golden State’s system rejects an indefensible number of upstanding citizens.
Gun rights supporters should be cautiously optimistic over recent DOJ developments
“California’s ammunition background check regime defies Bruen by imposing a burdensome and error-prone system that rejects a large fraction of eligible purchasers, denying law-abiding citizens their Second Amendment rights without historical justification,” SAF Director of Legal Research and Education Kostas Moros declared.
Moros added that there exists no history or tradition of such oppressive regulations and that the court should reject this legal fallacy.
California’s gun control regime adds a fee to every ammunition purchase and expressly bans residents of other states from buying ammunition there. This, the SAF contended in its release, is “unconscionable.”
Gun rights supporters are cautiously optimistic about the new DOJ direction. After all, the agency had an intentionally adversarial relationship with the weapons industry and firearm owners for many years before 2025’s abrupt change of direction.
