As more states opposed to Second Amendment rights dig in to launch attacks on the weapons industry, South Carolina lawmakers are bucking that trend.
State Rep. Chris Wooten (R) recently introduced House Bill 4723, the South Carolina Protection of Lawful Commerce in Arms Act. In a perfect world, such legislative maneuvering would be unnecessary, but this is not an ideal world.
Anti-gunners attempt to circumvent federal law protecting weapons industry
Despite the existence of the Protection of Lawful Commerce in Arms Act (PLCAA) for over two decades, anti-gunners persist in attempting to neuter the firearms industry. This federal law shields manufacturers from frivolous lawsuits filed with the intention of driving them out of business.
That should have been the end of it, but it was not.
Second Amendment opponents have little regard for the Constitution or the law as they seek to eradicate gun rights, so they are not going to let some silly federal statute get in their way.
Thus, South Carolina legislators are taking a necessary step to protect fundamental rights.
SC would join like-minded states in protecting the 2A industry
HB 4473 specifically would defend the industry, including retailers, distributors, and owners, from the kind of politically motivated lawfare that inspired the PLCAA in 2005. Opponents know that the Bill of Rights prevents them from banning guns outright, so they work to make them nearly impossible to possess legally.
The South Carolina proposal would not interfere with legitimate legal action over real issues. It would, however, stymie the deluge of baseless lawsuits that gun rights opponents would love to use to decimate the industry.
And in the process, it would reestablish the preeminence of Second Amendment freedoms for law-abiding South Carolina citizens. There would be no need for such a proposal without ongoing attacks on gun rights, so opponents of HB 4473 have only themselves to blame for the push.
