The Aloha State welcomes millions of visitors every year to enjoy its pristine beaches and tropical delights. Unfortunately, it is not a welcoming environment for those who wish to freely exercise their Second Amendment rights.
Now, another legal battle looms over the state’s obvious reluctance to issue a “permit to acquire” a firearm. This is an utterly useless hoop to jump through that does not address violent crime.
Plaintiffs accuse Hawaii County of ignoring state law
Attorney Alan Beck leads the charge against Hawaii County’s gun control regime. Permit applications are supposed to be processed within 40 days under state law, but the county views this mandate as merely a suggestion.
This is evident by Beck’s clients being forced to wait anywhere from 43 to 165 days just to obtain a permit to purchase a weapon.
To make matters worse, a unique permit is required for every single firearm transaction, and each application must include the details of the intended purchase. This just adds yet more burdens on law-abiding citizens who are the only ones who will bother to comply.
Law-abiding Hawaii residents face numerous roadblocks to gun ownership
First and foremost, this unwieldy process is a severe injustice to upstanding citizens who need a weapon to defend themselves. Waiting 40 days for the state to grant permission to exercise a constitutional right is a travesty.
Then the county apparently does not follow state law and makes applicants wait an even more inordinate amount of time.
As Beck noted, courts nationwide are striking down arbitrary waiting periods as violations of the Second Amendment. A mandatory seven-day period in New Mexico and a three-day wait in Maine did not pass constitutional muster.
The current lawsuit does not challenge the 40-day permit wait statewide. It instead focuses on Hawaii County’s failure to comply with the law.
