With Second Amendment organizations fighting valiant battles nationwide to defend gun rights, it is important to recognize and congratulate successes against government forces armed with virtually unlimited taxpayer funds.
Last week, the Second Amendment Foundation (SAF) and Firearms Policy Coalition (FPC) learned that their members—both current and future—are now exempt from the federal post office carry ban.
DOJ sought to limit the injunction’s scope to only current SAF and FPC members
The injunction against the enforcement of the federal policy was handed down in September. At that time, the SAF explained that “the government filed a motion to limit the scope of the injunction to only the named individual plaintiffs and to members of SAF and its partner organizations who were members when the complaint was originally filed and who have been identified and verified.”
In other words, government lawyers attempted to whittle the injunction down to a select few.
However, U.S. District Court Chief Judge Reed O’Connor rejected that ploy while expanding the injunction’s scope. He declared the action null and void for “all present and future members of Firearms Policy Coalition, Inc. and Second Amendment Foundation.”
2A organizations continue to successfully defend gun rights
SAF Executive Director Adam Kraut rightly lauded his organization for its success in defending the Second Amendment.
“This is a huge win for current and future SAF members nationwide,” the 2A advocate declared. “There was never a constitutional justification to disarm people who simply need to go to the post office. Despite the government’s attempt to continue to enforce this unconstitutional law against as many people as possible, the court today followed the law and confirmed that all current and future SAF members are covered by the injunction against the enforcement of this ban.”
The SAF, FPC, and two private citizens filed the challenge in June 2024.
