The ridiculousness of so-called “gun-free” zones is tough to overstate. By definition, violent criminals do not care one whit about the law and actually prefer these soft targets where good people are disarmed.
One lawmaker, U.S. Rep. John McGuire (R-VA), wants to recalibrate the scales of justice to give victims a fighting chance. According to his “Shall Not Be Infringed Act,” introduced last week, a person who suffers injury in one of these locales may bring civil action against the government entity that denied their Second Amendment rights.
Gun-free zones create the exact opposite environment from what they intend
“Gun-free zones do not prevent danger; instead, they make law-abiding citizens helpless victims,” McGuire declared in a press release. “Criminals do not care about the law, and it is our right enshrined in our founding documents to protect ourselves and our families.”
The representative added that if a government entity strips you of your right to self-defense, “then they need to take on that responsibility and be held accountable.”
A specific set of circumstances must be present for a citizen to have legal recourse.

Another individual’s firearm must have been used to harm the victim, the act must have taken place in a “gun-free” zone, the victim is authorized to carry in their state, and the injured party could have used a firearm to diminish or end the threat entirely.
McGuire’s bill features serious consequences for rebellious local or state governments. Federal funding for these entities’ crime prevention programs could be cut almost entirely, creating a bottom-line consequence for those who deny Second Amendment rights.
For years, advocates warned that these laws create soft targets where criminals believe they will not encounter armed resistance. Disarming law-abiding citizens and restricting their ability to defend themselves and their loved ones should come with a steep price.
