In an exclusive interview with Breitbart News, ATF Director Robert Cekada said his agency is expanding the recent federal court ruling against suppressor registration requirements to include all law-abiding American citizens.
In August, U.S. District Judge James Wesley Hendrix ruled that the longstanding, controversial federal mandate requiring registration of all suppressors and short-barreled rifles (SBRs) with the government was unconstitutional.
The ruling came after Congress removed the tax on which the registration requirement was based.
Ruling’s limited scope now applies across the nation
Cekada explained to the outlet that the narrow decision needed to be expanded.
“When the August 5, 2026, ruling came forward it benefited the plaintiffs, which was a very specific group of people,” the director noted. “ATF and the Department of Justice looked closely at the ruling and though the right path for us going forward was to apply it to all law-abiding citizens without requiring them to be a member of any sort of organization or to be a plaintiff in this particular matter.”
Celebration for the ruling was notably muted in its aftermath due to its application only to the plaintiffs and their members. Multiple organizations joined forces in fighting the relic of the now-defunct NFA tax scheme.
State hurdles remain, but the federal registration mandate is history
That’s over now, as Cekada declared. A favorable ruling that directly supports constitutional freedoms should apply to everyone who qualifies.
Understand, the ATF’s decision does not erase state laws that require registration for manufacturing or transferring suppressors and SBRs. The director added that his agency “does not have the authority to override those states or make them comply with our reading of what the ruling did or the policy that we put forth.”
The ATF will continue to accept state-mandated forms for these NFA-related items.
