The Minnesota Supreme Court spoke in a clear voice earlier this month and proclaimed that the state’s law-abiding residents may possess unserialized firearms.
It was the right call and long overdue, but that did not sit well with anti-gun forces in the State Capitol.
Minnesota AG believes allowing unserialized weapons is a threat to public safety
Minnesota Attorney General Keith Ellison (D) labeled the high court ruling as “concerning” before going on a rant against firearms dealers. The prosecutor tried but failed miserably to connect “ghost guns” and violent crime in the North Star State.
“The spread of ghost guns presents a serious threat to the safety of Minnesotans, which is why today’s ruling from the Minnesota Supreme Court is so concerning,” Ellison claimed in a statement to fox9.com. “To keep guns out of the hands of dangerous people, I have been working hard to hold firearms dealers accountable when they sell guns to straw buyers who then resell those weapons on the black market.
Other leaders echoed his sentiment against gun rights.
Anti-gunners smear unserialized firearms as “ghost guns”
Ellison’s reference to so-called “ghost guns” is disingenuous at best. He referenced firearms generally constructed at home by skilled hobbyists, a practice that has been ongoing for centuries.
A 1994 Minnesota statute prohibited anyone from receiving or possessing a weapon that is “not identified by a serial number.” It was under this law that a man was charged in 2022 with having a firearm without a serial number after a rollover crash.
A district judge initially threw the case out, but an appeals court reversed that decision, leading to the Minnesota Supreme Court taking up the controversy.
Declaring the 1994 law unconstitutional, justices wrote that the state did not have a system set up for serializing firearms. In addition, federal law does not require that the firearms in question have a serial number.
