California lawmakers continue to prove to their critics why warnings of “slippery slopes” need to be heeded, especially on Second Amendment rights.
In 2014, the state initiated its current Gun Violence Restraining Order (GVRO) law to intercede when an individual is suspected of being a danger to themselves and others. Anti-gunners push these so-called “red flag” laws, and they contain precious few safeguards for individual rights.
Instead, a law-abiding citizen faces losing their firearms without significant due process afforded to them.
California’s roster of people allowed to petition the court to strip gun rights keeps growing
Now, California has just launched an initiative that gives even more people the authority to petition courts to strip gun rights.
At first, only law enforcement and immediate family members could refer a person for a possible GVRO. That roster quickly expanded to include cousins and great-grandparents, current and former roommates, co-workers, employers, teachers, a parent of the person’s child, and anyone involved in a “dating relationship.”
And now that privilege is extended to prosecutors.
California ACLU weighed in on the new ‘red flag’ law
Gov. Gavin Newsom (D), even as he tries to reimagine himself as a gun rights advocate, signed AB 1344 into law last week. The program created a pilot initiative in four counties—Alameda, El Dorado, Santa Clara, and Ventura—to give district attorneys this right.
Besides the expected reaction from Second Amendment supporters, California ACLU is also upset by the new law. The group, which generally opposes gun rights, was adamant that prosecutors should not have this role.
“District Attorneys are not first responders in the traditional sense, and their role is not one of immediate crisis resolution,” the ACLU explained. The group added that the DA’s office is more punitive than preventative, which would create an unnecessary burden for the target of such an order.
