Second Amendment advocates anxiously await a long-overdue decision by the U.S. Supreme Court on gun rights and marijuana consumption. Strange bedfellows emerged in the buildup to the ruling, which is expected in early summer.
For example, the Donald Trump (R) administration defends the longtime prohibition and is backed by 20 attorneys general. All but one are Democrats who certainly do not normally march in lockstep with the White House.
In Colorado, a rift formed between the governor and the attorney general over this explosive issue, with both sides claiming the high ground.
AG supports White House’s position that marijuana users should not possess firearms—even when sober
AG Phil Weiser (D) adamantly opposes extending gun rights to pot users, even though his state has a strong sporting tradition and legalized both medicinal and recreational cannabis consumption.
Regarding U.S. v. Hemani, Weiser and his co-signers argued that “legislatures may, consistent with the Second Amendment, protect the public by imposing restrictions on firearm possession and carriage by habitual drug users.”
The anti-gun AGs believe that even sober individuals lose their freedom to keep and bear arms if they partake. Colorado Gov. Jared Polis (D), who has a history of playing both sides of the gun issue, disagreed.

The governor posted on X, “There is no reason that someone should be banned from exercising their Second Amendment rights simply because they use marijuana, especially when that logic is not being applied in the same way to other substances such as alcohol.
This marks a serious conflict in the ongoing debate over gun rights for pot users.
The Colorado government’s official position remains to strip 2A rights from marijuana users, something that the AG supports and the governor obviously opposes.
