Controversial ‘Red Flag’ Law to Take Effect in Maine After Tuesday Vote

Tuesday’s election results included a hotly contested decision by Maine voters to approve a sweeping “red flag” law that allows the confiscation of firearms with minimal, if any due process.

The Pine Tree State previously featured the so-called “yellow flag” law, a process “carefully crafted” to defend public safety and the due process rights of individuals. That was not enough for anti-gunners.

The new law means that there no longer must be an evaluation by a police officer or mental health official before firearms are seized. 

Even gun rights opponents recognized valid concerns about the new law

Maine Gov. Janet Mills (D) broke with party ranks leading up to this week’s election. She expressed concerns that Question 2 will sow confusion and place family members in a risky position that should be handled by law enforcement.

“If there’s a potentially dangerous situation, I want the police involved as soon as possible because it’s their responsibility, not yours, to deal with dangerous people,” Mills declared.

A growing number of states are ditching due process for confiscation

Mills is not normally opposed to gun control, but she reiterated that the proposal would destroy what had been a balance between public safety and constitutional rights. “Question 2 would create a new, separate, and confusing process that will undermine the effectiveness of the law and endanger public safety along with it.”

Maine on Tuesday became the 22nd U.S. state to enact “red flag” laws. It joined four of its New England neighbors—Connecticut, Massachusetts, Rhode Island, and Vermont—in fast-tracking the confiscation of guns from its citizens. 


This latest infringement on the right to keep and bear arms takes effect in January 2026. As controversial as the proposal was, it was approved by a wide margin—62% to 38% among those casting ballots.
