DOJ to Launch New Second Amendment Rights Section

The Department of Justice (DOJ) will launch a new component of its Civil Rights Division in December, tasked with protecting law-abiding Americans’ gun rights.

The Second Amendment Rights Section goes online on December 4. Its mission is to carry out President Donald Trump’s (R) Executive Order (EO) to restore the freedom to keep and bear arms to the status afforded it by the Founding Fathers.

There have been notable improvements at the DOJ, but much remains to be fixed

This new and improved DOJ is not without its critics. However, it has been active in challenging state and local statutes that run afoul of the Second Amendment, and the new section should continue that work.

The DOJ Civil Rights Division sued the Los Angeles Sheriff’s Department over slow-walking concealed carry permit application processing. It also argued in court against the controversial Illinois ban on so-called “assault weapons.”

And just last week, the Civil Rights Division stepped in with an amicus brief in the challenge to Hawaii’s oppressive gun control regime. The state requires gun owners to get expressed permission from property owners before carrying their weapons there.

True gun rights reform requires more than just lip service

The DOJ has fences to mend with the Second Amendment community.

Even in the wake of the EO that triggered recent reforms, there is still much to fix at the DOJ. 

The agency recently defended the utterly outdated National Firearms Act of 1934 (NFA) by arguing that short-barreled rifles and shotguns should be more heavily regulated than other firearms already are.

Then there was the agency’s recent request for membership rolls for the Second Amendment Foundation (SAF) and the Firearms Policy Coalition (FPC). Though this utterly misguided action was quickly rescinded, it offered further proof that there is considerable work remaining before gun rights are fully restored.
