FPC Declares Victory Over ATF’s Hated Pistol Brace Rule

The Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) unilaterally transformed scores of upstanding Americans into lawbreakers with its hated “pistol brace” rule.

According to the agency, a simple attachment somehow transformed everyday firearms into machine guns. 

That arbitrary and unconstitutional decree is no more, thanks to the agreed-upon dismissal of a lawsuit brought by the Firearms Policy Coalition (FPC). On Thursday, the organization reached an agreement with the federal government to shutter Mock v. Bondi.

FPC President lauds successful legal challenge to controversial ATF rule

The historic suit challenged the previous administration’s policy and resulted in the ATF rule being completely vacated. The Fifth Circuit had already decided against the agency, and Thursday’s agreement was the final nail in the coffin.

FPC President Brandon Combs celebrated the victory for gun owners with the appeal’s dismissal.

“As we explained in the case filings, braced pistols are not short-barreled rifles. But either way, they are unquestionably arms protected by the Second Amendment,” Combs declared. “We are thrilled to have secured this important win for liberty and excited to take on even more unconstitutional laws so you can exercise your rights when, where, and how you want to.”

Thursday’s agreement restored sanity to the ATF’s policy concerning pistol braces

In 2012, the ATF rejected the idea that attaching a pistol brace to a handgun altered its classification. Just two years later, the agency reiterated that the popular braces “did not reclassify [the pistol] as a short-barreled rifle.”

FPC Action Foundation President Cody J. Wisniewski went even further, blasting the effort “to turn millions of peaceable people into felons by decree.”

Wisniewski added, “This horrible rule was a perversion of our system of limited government, so we’re glad to see this case resolved in favor of liberty and the rule of law.”
