FPC to Appeal Setback in Texas Ruling on ‘Sensitive Places’

The Firearms Policy Coalition (FPC) is not discouraged by last week’s setback at the hands of a Texas judge. In a controversial decision, the jurist upheld the Lone Star State’s carry ban at a broad array of public facilities.

The Second Amendment advocates, along with three private citizens, brought Ziegenfuss v. Martin against the state. Despite its overall position supporting gun rights, Texas’s “51% Rule” bars firearms at any establishment that derives more than half of its income from on-site alcohol sales.

The sports-crazed state also bans weapons at most sporting events.

Sweeping Texas prohibition bars firearms in many crowded locations

In a powerful press release, the FPC equated the controversial ruling with the national pastime as ballparks across the nation get busy this week.

“Judge Pittman’s misguided opinion upholding Texas’s carry ban across wide swaths of public life—including at sporting events—isn’t even in the same ballpark as the Constitution,” the Second Amendment organization declared. “His decision is nothing but foul balls, so we’ve directed our attorneys to appeal this case to the Fifth Circuit without delay.”

The FPC expressed confidence that this infringement on the right to keep and bear arms will not stand. 

Controversial Texas law somehow withstood Bruen test

Pittman found that the ban withstood Second Amendment scrutiny and met the U.S. Supreme Court’s Bruen test by aligning with the nation’s “history and tradition” of gun laws.

“The court finds that the firearms prohibitions regulated conduct that falls within the plain text of the Second Amendment,” the ruling declared. “Further, Amici have demonstrated that Texas’s law is sufficiently analogous to historical laws prohibiting the carrying of firearms in sensitive places to justify Texas’s firearms prohibitions.”
