Grand Jury Declines to Indict Father in Kentucky State Defensive Shooting

A Kentucky State University father is in the clear today after a grand jury declined to indict him on a murder charge. The case stemmed from a fatal shooting in early December in which Jacob Lee Bard was charged after apparently defending his son and family.

The grand jury agreed.

Simply reporting a crime allegedly led to a wave of threats and violence

According to reports, Bard’s younger son reported a burglary in his dorm room to Kentucky State campus police in October. 

This allegedly set off a wave of retaliation against the young man that culminated in the fatal December 9 shooting. The frightening and utterly unprovoked incidents were described as “armed” and “violent,” something no college student should face simply for reporting criminal wrongdoing.

His family had enough and decided to remove both sons from the campus. Trouble exploded when the Bard family went to move their children from their residences along with two campus security officers for protection.

Two violent incidents in a matter of months left students shaken

The family was confronted by what their attorney described as 20 to 30 people bent on attacking the son. Defense attorney Scott Danks posted on social media that at the dormitory entrance on moving day, people in masks and hoods descended on the family.

The young son’s head was beaten into the pavement, according to Danks.

That’s when his father fired, striking and killing one alleged assailant and critically injuring another. His defense team argued that his reaction was “absolutely justified under the law” and that he was left with no other choice than to defend his family.

Pronounced dead was 19-year-old De’Jon Fox of Indianapolis. It was the second campus shooting in four months in the vicinity of the residence hall. 

The August incident unfolded when two people described as not being enrolled at KSU were shot in a drive-by attack. School officials told faculty and students after this shocking development left two wounded that they were committed to campus safety.
