House Leader Urges Significant Change to ATF Form 4473

The Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) will be forced to change its Form 4473 if a prominent U.S. House leader gets his wish.

Rep. Clay Higgins (R-LA) is the Chairman of the Subcommittee on Federal Law Enforcement. In a letter to Acting ATF Director Daniel Driscoll, the lawmaker explained his desire to defend good citizens from inadvertently misrepresenting themselves on these ubiquitous forms.

His primary concern is that individuals could inadvertently perjure themselves by answering the ATF questions.

“The Gun Control Act of 1968 prohibits individuals who have been convicted of certain crimes from legally purchasing a firearm,” Higgins wrote in his letter to the agency head. “For this reason, when individuals purchase a firearm, they are required to complete ATF Form 4473, which includes a question about their criminal background.”

Higgins continued. “The Gun Control Act of 1968 also includes restorative procedures for individuals whose ‘record and reputation are such that the applicant will not be likely to act in a manner dangerous to public safety’ and wish to again exercise their Second Amendment rights.”

The lawmaker noted that there are several other instances, such as applying for employment or housing, where, after an extended period of time, the applicant may truthfully answer “no” to the question of whether they have a criminal record.

A misrepresentation on Form 4473, however, could result in up to 15 years in prison.

Last year, Higgins introduced the Second Amendment Rights Restoration and Accountability Act. This sought to force the ATF to update Form 4473 to clarify for applicants that there are exceptions for individuals who receive a pardon.

Furthermore, the form would provide updated and correct information on how to fill it out properly and avoid legal trouble. This could save a well-intentioned person from having their life destroyed by an honest mistake.
