Second Amendment advocates have another victory to celebrate — this time in Pennsylvania. On Wednesday, a district court ruled in Lara v. Evanchick that young adults aged 18-20 are now eligible to apply for a concealed carry permit.

The state’s previous ban on this age group fully exercising its constitutional freedoms was struck down. 

Further, the court determined that the law prohibiting young adults from open carry during an emergency also ran afoul of the Constitution.

The successful lawsuit was brought by the Firearms Policy Coalition (FPC), the Second Amendment Foundation (SAF) and three private plaintiffs. 

Judge William S. Stickman ruled that the law banning concealed carry by upstanding young adults violated the Second and Fourteenth Amendments. He also cited the Heller decision which upheld the right to be armed for self-defense.

In the case involving a state of emergency, Stickman declared the Pennsylvania State Police are “hereby enjoined from arresting law-abiding persons 18 to 20 years old who openly carry firearms.”

Courts have consistently ruled that “the people” as described in the Second Amendment includes young adults. 

FPC founder and President Brandon Combs celebrated the victory. “History and legal precedent plainly show that these types of age-based bans are completely unconstitutional. This latest FPC victory is a significant step towards restoring the right to keep and bear arms throughout the United States.”

Adam Kraut, executive director of the SAF, was also pleased by the ruling. “Now 18- to 20-year-olds in Pennsylvania may apply for [a] license to carry firearms and the state’s draconian transportation laws have been enjoined from enforcement. This is a victory for Second Amendment rights in Pennsylvania.”

Yet again, the importance of private defenders of constitutional rights is made clear. Both the FPC and SAF dedicated significant time and resources to ensuring that lawful gun owners in the Keystone State are protected, and they deserve both support and respect.
