Judge Upholds Constitutionality of Illinois Suppressor Ban

Illinois residents are under some of the harshest anti-gun laws in the nation, and one of the oppressive measures was just upheld by a district judge.

The state has the dubious distinction of being the only one in the Union that has a blanket ban on suppressors. This despite the obvious medical benefits of preventing hearing loss from years of unprotected shooting.

The lack of suppressors during the Founding Era became an excuse for upholding their prohibition

Judge David W. Dugan of the U.S. District Court for the Southern District of Illinois determined last week that suppressors are not “arms.” Lacking that distinction, he concluded that they do not fall under the protection of the Second Amendment. 

He began his writing by speculating that the Founding Fathers were unaware of the technology that would eventually reduce the sound of firearms. This, Dugan reasoned, countered the plaintiff’s arguments that silencers fall under the Second Amendment description of “arms.”

Ultimately, he determined that silencers are unprotected, meaning the Illinois ban remains in effect.

Instead, Dugan applied misguided logic that would virtually eradicate gun rights if applied nationwide. 

“Plaintiff has not shown that silencers are modern forms of weapons known to be in use or available in the ratification period,” he said. “The Plaintiff’s complaints and the record are devoid of any reference to a time in the history of our country where any early generation device, accessory, or attachment was broadly employed to reduce the report of a firearm.”

Never mind that the federal tax on firearm suppressors is now history. And ignore that the standard imposed by Dugan could be used to wildly infringe on the right to keep and bear arms.

What is plain is that voters must elect more pro-gun leaders in the Prairie State to turn the anti-gun tide. Constitution-minded lawmakers would respect Second Amendment rights and usher in judges who adhere to the law of the land.
