Justice Alito’s Rumored Retirement May Create Opportunity for Gun Rights

Second Amendment advocates know well that the ideological makeup of the U.S. Supreme Court is critical for defending gun rights in the 21st century. 

With some notable exceptions, the high court, as currently constituted, generally follows a constructionist approach to gun rights. But that majority is hardly guaranteed, and a death or sudden retirement could throw the balance into question.

An unexpected high court vacancy could spell trouble for gun rights

Now, swirling rumors suggest Justice Samuel Alito is considering stepping down from the bench after 20 years. He has been a sturdy gun rights supporter who takes a dim view of those who attack the freedom to keep and bear arms.

Alito is 75 years old and has a book release coming in October—exactly one day after the next Supreme Court term commences. 

Speculation runs rampant that he will retire to give President Donald Trump the chance to fill his position with a like-minded jurist.

November elections could greatly alter the confirmation path for a SCOTUS nominee

With midterms set for November, there are no guarantees of which side of the political aisle will control the congressional reins next year and beyond. After Justice Ruth Bader Ginsburg died in 2020 at age 87, many of her supporters questioned why she had held on to her position for so long and why her ideological opposite ultimately replaced her.

Conservative gun rights supporters are expected to hold onto the Senate after November, though nothing is guaranteed. If the balance of power were to flip, replacing Alito with another gun rights supporter would be substantially more difficult.

Alito was one of the judicial giants behind the landmark 2022 Bruen decision that went far in restoring Second Amendment freedoms for law-abiding Americans. Replacing him with a justice with similar leanings would help safeguard gun rights for future generations.

And Alito is not the only potential retiree. Gun rights stalwart Clarence Thomas turns 78 in June.
