Lawmaker Proposes Ban on State Magazine Capacity Restrictions

The patchwork quilt of state laws governing the legal capacity of a firearm magazine has caught the attention of at least one Washington lawmaker, who proposed a fitting solution.

Rep. Tony Wied (R-WI) introduced the Freedom from Improper Regulation and Enforcement Act (FIRE Act). It would erase arbitrary state laws that restrict magazine capacity to 15 or even ten rounds.

For too long, anti-gunners have smeared these quite common accessories as “high capacity,” meaning to imply that they are somehow uniquely dangerous and should be banned.

Wied explained his position on X: “For too long, the government has infringed on our 2nd Amendment rights. That is why today I introduced the FIRE Act to ensure that law-abiding gun owners can access magazines of any size, no matter where they are in the U.S.”

How many of these magazines are in circulation in the U.S.?

A report from the National Shooting Sports Foundation (NSSF) last year logged some 973 million detachable magazines produced domestically between 1990 and 2021. Some 718 million of these attachments hold more than ten rounds, making them illegal in several states.

Other legislators lined up behind Wied and the proposal.

Rep. Tom Tiffany (R-WI) declared that the FIRE Act “protects law-abiding gun owners and keeps state and local governments, as well as future administrations, from infringing on your Second Amendment rights.”

And his colleague, Rep. Dave Taylor (R-OH) chimed in that, if passed into law, the bill “will not only enshrine Americans’ right to self-defense, but it will also remove confusion about permissible magazine capacities.”

Taylor added that gun rights are one of the “foundation principles America is built on, and they must be vigilantly affirmed and protected.”
