While 2025 saw a course correction in the Department of Justice’s (DOJ) recent antagonism toward Second Amendment rights, the need for vigilance remains.
With that in mind, 42 U.S. Senators and Representatives implored officials to reexamine the National Firearms Act of 1934. Specifically, the registration requirement for suppressors and short-barreled rifles that remains in place despite the elimination of the federal tax on these items.
Rep. Andrew Clyde spearheaded the charge and penned a strong letter to Attorney General Pam Bondi (R).
Officials’ letter implored DOJ to remove NFA registration mandate
“In light of the Department’s recent filing opposing this interpretation, we must express our serious concern and disappointment that the Department of Justice has chosen to advance a theory that not only conflicts with Congress’s express intent but also disregards the constitutional structure upon which the NFA has rested since 1934,” the lawmakers wrote.
The NFA registration requirement must be null and void without the tax, according to the letter:
“Moreover, the NFA’s criminal provisions pertain exclusively to the failure to pay or register the payment of this tax with the ATF. Any reinterpretation of the NFA that allows registration to persist once taxation has been removed contradicts the statute’s text, its structure, and Supreme Court precedent.”
Anti-gunners will seize on any opportunity to disarm the public
Bondi’s DOJ filed a brief defending the hated registration requirement, sparking concern in the 2A community.
After all, Australia now provides American gun rights supporters with a shining example of how anti-gunners will capitalize on criminal acts to strip firearms from their hands and homes.
Any provision that permits the federal government to collect and maintain a registry of firearms must be opposed with all available resources. Kudos to these lawmakers for taking a stand against the DOJ, which should protect 2A freedoms rather than limit them.
