Legislation to Restore Veterans’ Gun Rights Advances in House Despite Criticism

It is a cruel irony that the very same veterans who defended the freedoms of all Americans are being denied their Second Amendment rights simply for needing assistance handling their financial affairs.

 

And predictably, at least one anti-gun group is all-in on stripping the right to keep and bear arms from these heroes.

 

On Tuesday, a significant advance was made to address this blatant wrong. The House Committee on Veterans’ Affairs put its stamp of approval on the Veterans 2nd Amendment Protection Act, meaning it is closer to being presented to the full House.

 

The National Rifle Association (NRA) lauded the achievement with a post on X and acknowledged the irony of veterans losing their freedoms on a bureaucratic whim.

 

The venerable organization wrote, “The NRA was proud to be on Capitol Hill today backing this crucial bill to protect the Second Amendment rights of our Nation’s heroes—the very rights they fought to defend.”

 

Congressional proponents of denying gun rights to veterans claim that such actions suppress suicides among this group. But Rep. Eli Crane (R-AZ), a powerful supporter of the bill, ripped this illogical thinking from an actual veteran’s perspective.

 

The former Navy SEAL posted on social media that many veterans live in fear of losing their gun rights after facing armed enemies while they were in service of the U.S. “One of [their] biggest issues is fear and trauma because [they] thought [they] might lose [their] life in battle against other people with guns.”

 

Amazingly, the anti-gun group Giffords lined up firmly on the side of ripping hard-won freedoms away from those who deserve them the most. In a statement, the organization charged that the “gun lobby” is putting veterans’ lives at risk.

 

“This legislation would be one of the most significant weakenings of our federal background check system in recent history,” Giffords claimed. “It prohibits the Department of Veterans Affairs (VA) from reporting to the National Instant Criminal Background Check System (NICS) beneficiaries deemed ‘mentally incompetent’ by the VA on the basis of being assigned a fiduciary to manage their affairs due to injury or disease.”

 

Exactly.

 

According to Giffords, the need for a fiduciary to manage finances is akin to being a convicted felon who should not possess a weapon. Is it any wonder that the nation’s veterans are outraged at this brazen infringement on their fundamental constitutional rights?

 

Texas Public Radio presented a fascinating case study on one of our nation’s heroes who is trapped in this legal quagmire.

 

National Guardsman Corey Briest was in Baghdad in 2005 when a terrorist roadside bomb hit him and his fellow troops. He survived even though three of his military colleagues were killed in the attack, but Briest had a long road to recovery.

 

He suffered a traumatic brain injury, leaving him blind and in a wheelchair as he convalesced in South Dakota. Briest made a remarkable comeback, and his wife Jennifer told the outlet that his faculties are mostly intact. 

 

The veteran is active in his family life and works to ensure his loved ones are financially stable. However, the VA determined that Briest needed a fiduciary to assist with his money matters, and because of this, a field examiner told him that he could no longer possess guns.

 

Briest explained that he had a family heirloom, a gun belonging to his grandfather, that he intended to pass down to his son. That did not sway the VA bureaucrat.

 

Jennifer recalled, “The field examiner was so rude about it. Wasn’t compassionate to Corey. Wasn’t explaining things. He was just like, ‘Nope, you can’t have that…that’s against the law.”

 

The antique firearm was then moved to a family member’s residence to comply with the misguided law. However, thanks to the House bill gaining traction, this miscarriage of justice and scores of others like it may soon be corrected.
