Of course, a few changes in the process that did not work might be in order, and that’s the thinking of a group of gun rights advocates in Missouri.
Show-Me State lawmakers made waves last week when they introduced a proposal modeled on 2021’s ill-fated Second Amendment Protection Act.
The new Missouri effort is led by Rep. Bill Hardwick (R). While he introduced the bill to his colleagues, he gave specific examples of what the ungraded legislation would establish.
“If there’s a federal gun registry, state police should not enforce that,” Hardwick asserted. “If there’s a federal rule about the amount of bullets that you can have in your home, the state police should not enforce that.”
Supporters believe the new proposal is different enough from its predecessor that it will withstand judicial scrutiny.
When the previous law was passed four years ago, then-Gov. Mike Parson (R) declared that the measure would stand tall against federal overreach into Second Amendment freedoms.
State-level officials were barred from enforcing federal laws deemed unconstitutional. This was a time when gun rights advocates charged that the federal government in general and the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) specifically were weaponized against firearms.
Parson told supporters and critics alike four years ago that the statute “draws a line in the sand and demonstrates our commitment to reject any attempt by the federal government to circumvent the fundamental rights Missourians have to keep and bear arms to protect themselves and their property.”
That stand was short-lived, however, as the Department of Justice quickly filed a suit against it.
Federal lawyers successfully argued that the act impeded necessary cooperation between federal and state officials. A lower court agreed, and the state promptly appealed to the Eighth Circuit Court of Appeals.
The appellate court unanimously upheld the lower court’s ruling, citing the Supremacy Clause. This established that federal law superseded state law, and state governments are not allowed to nullify federal statutes.
