The Missouri Supreme Court last week enhanced self-defense rights for law-abiding citizens, and it barely lifted a finger.
Justices declined to hear a challenge to a significant appellate court ruling handed down last November. That case involved a shooting incident at a homeless shelter in Jefferson City in which a former Marine defended herself against an attack from another woman.
Veteran convicted of using a weapon in an altercation with another woman
Veteran Danielle Lechocki was reportedly attacked by the suspect and pulled a knife to defend herself. She used the bladed weapon due to feeling “extremely threatened,” as she described the 2022 incident to investigators.
A seemingly clear-cut case, but it was hardly so simple.
The Warren County judge did not allow Lechocki to use self-defense to explain how she reacted to the threat. Instead, the jurist sided with the prosecution, which argued that the veteran’s use of deadly force was excessive to defend against the attack.
Critics oppose expanding self-defense arguments used by victims
Without this argument, she was found guilty of attempted unlawful use of a weapon. But Lechocki was acquitted on her charge of fourth-degree assault, resulting in a sentence of two days in jail and a $1,000 fine.
The former Marine did not accept this outcome, and in November the Missouri Court of Appeals for the Eastern District determined that her use of force was justified—even if she did not face a potentially lethal assault.
Lechocki can celebrate the overturning of her conviction, even though the possibility remains that the county may still act against her.
Public defender Christian Lehmberg told reporters that the appellate court “recognized this injustice” of his client not being able to properly defend herself in court.
“As a result, a woman with no criminal history was convicted without having been allowed to present the very defense that explained her actions,” Lehmberg explained. “We hope to resolve the matter without needing to go through another trial. Ms. Lechocki has suffered enough.”
Critics charge that small conflicts will now be used to justify unnecessary escalations.
