Contentious “red flag” restrictions have no place in Montana, thanks to Gov. Greg Gianforte (R) signing HB 809 into law this week.
Cities and other local governments are now barred from enacting measures to strip gun rights from citizens without due process. They are also prohibited from receiving grants that would support adopting such laws.
Gianforte posted on X that his signature aligns with the state’s heritage of protecting Second Amendment rights for law-abiding citizens. “Just signed into law House Bill 809, banning local governments from enacting red flag laws. Protecting our God-given freedoms and our way of life is not a question in Montana.”
The governor continues to make waves in support of gun rights.
After Colorado lawmakers enacted their latest controversial gun control measures, Gianforte rolled out the red carpet for the state’s firearm industry to pack up and head north to a more friendly territory.
He noted that Colorado is in the top ten states for the most significant gun industry within its borders. “So, to all gun manufacturers in Colorado, my question is simple: Do you want to move back to America? Montana is open for business.”
There are no groups more committed to keeping firearms out of the hands of dangerous criminals than Second Amendment advocates. However, eradicating due process and trampling on constitutional rights is not the way to accomplish this.
The National Rifle Association (NRA) summed up the opposition to such vague statutes.
The organization wrote, “Red flag laws allow governments to seize firearms based on weak and nebulous standards of evidence and implement ex parte hearings that would suspend an individual’s Second Amendment rights without due process.”
The end does not justify the means, and all too often, these laws are pushed through by anti-gunners simply looking for another avenue to strip constitutional rights away from good citizens.
