New Mexico’s anti-gun regime will ask a federal appeals court to take another look at its pause on the state’s controversial waiting period to purchase a weapon lawfully.
This is just the latest blow to Gov. Michelle Lujan Grisham’s (D) crusade to eradicate Second Amendment rights. She signed the waiting period into law in May 2024, but a three-judge panel of the Tenth Circuit Court of Appeals enjoined her action.
Grisham decided to appeal the decision against the waiting period
Now the state plans to ask all 19 of the court’s judges to weigh in on the issue. Unfortunately, the contentious law remains in effect while the petition for a rehearing is considered.
Such requests generally follow significant decisions or ones for which there is no judicial consensus.
For example, the Tenth Circuit previously upheld a Colorado law prohibiting those under 21 from purchasing firearms. This amounts to a three-year waiting period for a law-abiding adult to exercise their Second Amendment rights.

Grisham should be accustomed to such disappointments, having watched her scheme to disarm thousands of New Mexico residents unravel under judicial scrutiny. She was quick to smea the appeals court determination as “deeply disappointing.”
She indicated that her office would not abide by the decision.
“This ruling ignores a recent binding Tenth Circuit precedent that upheld Colorado’s law barring purchases by anyone under the age of 21—a law that requires 18-year-olds to wait three years to purchase a weapon,” Grisham claimed.
Another contentious aspect of the waiting period law is the change from the current federal standard. If the background check is not completed within three days, the seller may now transfer the weapon to the buyer.
New Mexico’s law extends that period to a ridiculous 20 days.
