New Oklahoma Law Permits ‘Defensive Display’ of Firearm to Protect Property. Very little is more fundamental and sacred than the right to defend loved ones and property. This goes to the very heart of the Second Amendment and what it means to be an American.

While Oklahoma law already protected the right to self-defense, it was not explicit in recognizing the liberty to take an armed stance for one’s home, business, or other private property.

For the Sooner State, that God-given freedom is enshrined in a new law that protects the right to use “defensive display” of a weapon for protection.

Displaying a weapon to protect property is now lawful in Oklahoma

Gov. Kevin Stitt (R) signed HB 2818 into law Thursday. The statute clearly defines instances in which law-abiding citizens can brandish a weapon to protect themselves and their property.

These include telling another person that you have a gun or that one is available. The citizen may hold or show a weapon to others in a manner reasonable people would take to mean they intend to protect against a violent attack.

The defender may also place their hand on a weapon in a pocket, purse, case, or other container to indicate their willingness to use lethal force for protection.

Oklahomans may now freely exercise their Second Amendment rights to protect property

The new law took effect immediately.

Despite the protestations of anti-gunners, the law is not a blank check for Oklahomans to point a weapon at anyone for any reason. 

Rep. Jay Steagall (R) authored the bill and defended it from House critics who questioned its wisdom. In March, he explained that the law still prohibits people from pointing a gun “for purposes of whimsy, humor, or prank, or in anger.”

Steagall reiterated that the goal was to clearly define situations in which “defensive display” was lawful in Oklahoma.
