NRA Sues Florida Over 3-Day Waiting Period for Firearm Purchases

When examining states and their relationships with the Second Amendment, Florida has an unusual status. 

On the one hand, Sunshine State leaders are generally strong gun rights supporters who say and do the right things for the shooting community. They are pro-self-defense and stand for the rights of upstanding citizens against violent criminals.

However, there remain curious holdovers still on the books from past anti-gun regimes, and advocates want to see these removed for good.

Plaintiffs seek to overturn Florida’s controversial waiting period

The National Rifle Association (NRA) this week partnered with the 2nd Amendment Armory and others and joined the Mountain States Legal Foundation in challenging Florida’s three-day waiting period for weapon purchases. 

The NRA posted its reasoning on X regarding why the organization opposes the waiting period.

“In Florida, law-abiding Americans who pass a background check are still required to wait a minimum of three days after the background check is initiated before taking possession of their firearms.”

Pro-Second Amendment forces are attempting to roll back gun control infringements

Voters approved a constitutional change in 1998 to implement a three-day waiting period on handgun transactions in a misguided attempt to address a decade of explosive violent crime. 

Exceptions were carved out for concealed carry permit holders and those who traded in another weapon. Then, following 2018’s Parkland school shooting tragedy, the statute was expanded to include all long guns.

There was a knee-jerk reaction even among some “reliable” Second Amendment supporters after Parkland to clamp down on gun rights. However, advocates quickly realized that some “reforms” went entirely too far and now work to reverse these missteps. 

A significant step in that process would be to eliminate the redundant background check process, which imposes unnecessary restrictions on good citizens.
