SCOTUS To Decide Whether to Hear Case Over California’s Standard Capacity Magazine Ban

The long and winding road of the ferocious battle over California’s ban on standard capacity magazines is finally before the U.S. Supreme Court.

On Friday, November 21, justices are scheduled to determine whether to accept or deny Duncan v. Bonta. This case has ping-ponged through the lower courts with mixed results since July 2017, and it begs for intervention by the high court.

U.S. gun owners should carefully watch the court’s Friday decision.

It is a positive sign that SCOTUS set a conference date for Duncan

In March, an en banc court of the U.S. Ninth Circuit overturned a pivotal 2023 decision by U.S. District Court Judge Roger Benitez that struck down the California statute. This thwarted the previous success in challenging the California law and set up a potential Supreme Court showdown.

Chuck Michel is an attorney for gun rights advocates who sought consideration.

“The Court could have denied the petition outright, but instead it placed Duncan into active consideration—an encouraging development for all who support the Second Amendment,” Michel told Guns.com. “This means the case is now squarely before the court—a major step forward for what could become the next landmark Second Amendment decision.”

The gun rights community is rallying around this case to urge the bench to grant review. The National Shooting Sports Foundation (NSSF), Gun Owners of America (GOA), the Second Amendment Foundation (SAF), the National Association for Gun Rights (NAGR), and other influential groups submitted amicus briefs to the court.

Attorneys General from 27 states also urged the Supreme Court to decide the controversy. A favorable ruling would go far to intercede in the recent push by anti-gun state and local governments to suppress all gun magazines capable of holding more than 10 rounds.
