Supreme Court to Discuss Marijuana Users’ Gun Rights in September

The U.S. Supreme Court has a unique opportunity later this year to have a defining moment on the issue of Second Amendment rights and marijuana users.

Laws for centuries prohibited intoxicated persons from having firearms while under the influence, and rightfully so. No one wants weapons in the wrong hands, and this is not a topic that is seriously debated.

But what about alcohol users who are not currently intoxicated? They are perfectly within their rights to possess a gun and therein lies the dilemma.

The federal government clings to what many believe is an antiquated marijuana policy

Marijuana use, which of course is legal in large swaths of 21st-century America, is treated wholly differently. 

Even in states that legalized use for recreational purposes or simply as medicine, the fact that a person occasionally partakes is enough to eradicate their Second Amendment freedoms.

Finally, the Supreme Court is scheduled to talk about the issue in September.

High court will determine whether to take up key case involving marijuana and the Second Amendment

The justices will convene privately on Sept. 29 to discuss whether to take up U.S. v. Cooper. A federal appeals court recently struck down the conviction of a defendant accused of possessing a firearm while being a habitual marijuana user.

There have also been decidedly mixed signals from federal courts nationwide, which of course scream for high court intervention. Only, justices have been notably hesitant to take up what appear to be pivotal Second Amendment cases.

Again, no one is arguing for intoxicated persons having access to weapons; that’s just fundamental gun safety. But the use of intoxicants while not controlling a weapon resulting in a blanket ban is another issue entirely, and one that justices would do well to consider.
