Texas Lawmakers Seek to Hold Businesses that Disarm Customers Liable

If a Texas business denies a customer the right to carry their firearm and that person is injured or killed, the entity opens itself up to civil liability damages.

 

That’s the goal of Senate Bill 82. If passed, the proposal would certainly give pause to establishments that post signs banning lawful carry on their premises. 

 

The bill states: “A person with control over the premises of a business who prohibits entry on the premises by a license holder with a concealed handgun by posting a sign on the premises as described by Section 30.06, Penal Code, is liable for damages arising from a criminal act occurring on the premises.”

 

One local Second Amendment advocacy group quickly applauded the bill.

 

President of Texas Gun Rights (TXGR) Chris McNutt said the proposal would enhance public safety and individual freedoms.

 

“If a business is going to post a sign that disarms law-abiding citizens, then they should be prepared to answer for what happens when criminals strike,” McNutt declared. “This is about basic accountability and public safety—not politics.”

 

Texas currently permits businesses to prohibit licensed handgun owners from carrying on their property by posting a sign. While that right would remain, the bill’s passage would mean that the owner/s assume responsibility for damage caused by criminal acts that a legal weapon could have stopped.

 

TXGR Legal Counsel C.J. Grisham told the Senate State Affairs Committee that when businesses strip gun rights from customers, they are making a profound security decision.

 

He declared that businesses should be liable for the consequences of their actions. If customers can no longer carry weapons for self-defense and a violent incident occurs, the company would now have the responsibility to protect its clients or face accountability.

 

If the proposal clears the committee it will be taken up by the full Senate.
