Keeping up with how many Commonwealth Attorneys in Virginia are announcing they will not enforce or pursue charges brought by a controversial new law set to take effect in weeks is like watching the stock market or baseball scores.
First it was one, then two, and at last report there are at least seven prosecutors saying thanks but no thanks to the pending law. Governor Abigail Spanberger (D) signed the ban on most so-called “assault weapons” and “high-capacity magazines” capable of holding over 15 rounds.
As gun rights activists and civil libertarians express their disappointment at such grandstanding, Virginia’s leadership struck back.

Spanberger’s office delivered the expected doublespeak in a statement to Virginia Scope, simultaneously demonizing the Second Amendment and claiming that stripping gun rights from law-abiding citizens will make communities safer.
“The people of Virginia must be able to trust that all Commonwealth’s Attorneys will uphold the rule of law and keep Virginians safe,” the governor added.

If you ask the prosecutors, they will unanimously agree that they are indeed upholding “the rule of law.” It’s the Constitution and the U.S. Supreme Court, the two-headed monster standing between gun rights foes and outright confiscation.
Meanwhile, controversial Attorney General Jay Jones (D) sang the same tune to the outlet.
“The General Assembly passed and the Governor signed critical legislation to reduce violent crime and protect our communities. Commonwealth’s Attorneys are elected to enforce our laws, which is what we expect them to do when these laws take effect on July 1,” Jones said.
One, Spotsylvania County Commonwealth Attorney Ryan Mehaffee, cited multiple high court decisions that easily overrule anything anti-gun lawmakers may concoct.
“You look at the Miller decision, you look at the Bruen decision, you look at the Heller decision,” the prosecutor explained. “Whatever statute is passed by the General Assembly, however well-meaning it may be, it’s going to be incapable of superseding the supreme law of the land, which are the constitutional protections of the people.”
He added that bans on the most popular sporting rifles in the country are clearly unconstitutional.
