Washington State Ban on Standard-Capacity Magazines Upheld. Without the means to ban firearms outright, which of course is the aim of many lawmakers, anti-gunners must resort to attacking the right to keep and bear arms through other avenues.
One way is banning standard-capacity ammunition magazines through arbitrary limits, as Washington legislators accomplished in 2022. The current law prohibits the sale, manufacture, and import of magazines capable of holding more than 10 rounds.
Unfortunately for the state’s gun enthusiasts, the Washington State Supreme Court upheld that law last week.
Justices found that magazines are not “arms” and thus not protected by high court rulings
The state sued a Washington gun shop for selling standard-capacity magazines, and a lower court agreed with the business.
That victory was short-lived, however, as the case went to the Washington Supreme Court for review. Justices on a 7-2 vote determined that these magazines are not considered “arms” but rather components.
The high court further ruled that the aforementioned magazines are not used for self-defense.
The decision is another blow for Washington state gun owners
Justice Charles Johnson wrote Thursday’s opinion. “By restricting only magazines of a capacity greater than 10 rounds, the statute effectively regulates the maximum capacity of magazines, leaving the weapon fully functional for its intended purpose.”
Two justices dissented from the majority.
One, Gordon McCloud, argued that millions of Americans own semi-automatic firearms “as the primary tool for lawful purposes.”
She added, “It necessarily follows that the Second Amendment protects the arms-bearing conduct at issue here.” Judges are increasingly bypassing Supreme Court rulings such as Heller and Bruen, which uphold the right to keep and bear arms. Instead, they focus on a technical and highly specific definition of what an “arm” is, and therefore feel free to regulate mechanisms that are part of everyday firearms.
