Hawaii Pushes More Ridiculous 2A Infringements Ahead of Likely Defeat

When defeat is all but certain, the best course of action may be to assess what brought things to this point and determine how to avoid reaching the same outcome in the future.

However, Hawaii’s strident anti-gun lobby has another philosophy.

With a significant setback looming before the U.S. Supreme Court in Wolford v. Lopez on Second Amendment rights, state lawmakers decided to double down and endorse even more ridiculously unconstitutional measures. And their reasoning is one for the history books.

Lawyers make ludicrous claims about Hawaii and the Constitution

Hawaii officials argued to support their contentious “vampire rule,” which prohibits concealed carry of weapons on private property open to the public without the owner’s express consent. Incredibly, lawyers contended that its background as a kingdom should supersede the U.S. Constitution.

The brief wildly claimed that the island state has “traditions that predate joining the Union, and they should reign supreme over the Constitution.”

Then there’s the new proposals.

New proposal would require citizens to carry a stun gun

SB 3039 would require anyone legally carrying a firearm also to have “an electric gun.” That’s right. Any law-abiding citizen exercising their Second Amendment rights would be forced to carry a stun gun at the same time or risk losing their license.

The bill asserted that “carrying a lethal firearm as the only means of defense often increases danger to the public.”

Perhaps, if “public” is now a euphemism for violent criminal.

Then there’s SB 3041, proclaimed as a replacement for the likely doomed “vampire rule.” Businesses or restaurants serving the public would be mandated to display a color-coded placard announcing whether firearms and large knives are permitted.

A green placard would indicate that guns and large knives are prohibited, while a yellow placard would indicate that one, but not both, may be possessed. A red placard would show that both guns and large knives are welcome.
