OLC: Post Office Carry Ban Cannot Be Enforced

Between federal law and U.S. Postal Service rules, law-abiding gun owners have, for decades, effectively been prohibited from possessing weapons when conducting affairs on their property.

If the final nail has not been driven into this misguided policy to disarm good people, it got much closer last week with welcome news from the Department of Justice Office of Legal Counsel (OLC). 

USPS carry bans should be only a bad memory

The OLC announced that, after years of lawsuits challenging the arbitrary and unconstitutional restriction, federal law does, in fact, allow people to carry a firearm on USPS property legally. The Postal Service can no longer enforce its myriad bans on such actions.

For too long, a person going about their daily business faced being stripped of their primary self-defense tool when they picked up mail or sent a package. 

As the National Rifle Association (NRA) noted after the OLC revelation, USPS restrictions “increasingly collided with U.S. Supreme Court rulings culminating in various litigation challenges” concerning the people going about their daily lives while lawfully possessing a weapon.

OLC extended ‘lawfully carrying’ to its logical conclusion

The OLC noted that Congress did not create a blanket ban on carry in such facilities, but instead exempted the “lawful carrying” of firearms or other dangerous weapons “incident to hunting or other lawful purposes.”

Self-defense being an obvious legal purpose, “that exception permits the lawful carrying of constitutionally protected firearms in post offices.”

A federal District Court in 2025 acknowledged this reality when it permanently enjoined federal enforcement of this prohibition–for members of the organizations that sued over the restriction. The DOJ appealed, but that was short-lived.

In July, the DOJ withdrew that action and solidified the Second Amendment triumph.

As the OLC explained in plain English, “carrying arms for self-defense when entering a building held open to the public is a paradigmatic lawful purpose.” And that should be that.
