Assistant Attorney General Harmeet Dhillon went on the record this week in an interview with Just the News with a prediction that certainly raised eyebrows.
The federal official told the outlet that she believes the U.S. Supreme Court is poised to strike down local and state bans of AR-15s and similar semi-automatic rifles.
Assistant AG pointed out Denver’s now-contested ban of semi-automatic firearms
Dhillon explained to Just the News that the high court is quite likely to lay down the law to states that have no respect for constitutional rights. She referenced the DOJ’s ongoing lawsuit against Denver officials for their sweeping firearm restrictions.
“The Constitution is not a suggestion, and the Second Amendment is not a second-class right,” she argued. “Denver’s ban on commonly owned semi-automatic rifles directly violates the right to bear arms. This Department of Justice will vigorously defend the liberties of law-abiding citizens.”
SCOTUS may ultimately settle the nationwide controversy
Then the Assistant AG turned directly to bans on popular sporting rifles popping up in anti-2A states, describing the potential for the high court taking up one of these “low-hanging fruit” cases.
“…The Supreme Court held in a 9-0 opinion in the Smith & Wesson case that the AR-15 is the most commonly owned and operated rifle in the United States,” Dhillon told Just the News. “And so, when you add that statistic to the ruling in the Bruen and Heller decisions, which talk about firearms that are in common use and for law-abiding citizens, that leads to the inexorable conclusion that the AR-15 is presumptively legal all over America.”
Dhillon believes that differing opinions on the issue expressed by lower courts mean SCOTUS will, sooner or later, step up to the plate.
She noted that justices had already signaled on their possible stances in other cases, and this is a positive sign that the AR-15 may be here to stay.
